Yeah there is a flea market every sunday in my city and after it finishes every time I go take a look at what remained abandoned in the street.. Another time I found an original PlayStation.. Never tried to see if it worked though.. Besides I have two modded PS2 and one PS3 so why bother? For the unfiltered textures?

Legal-shmegal, I prefer to look at things from a purely practical point of view: If you buy such an old game from eBay, flea markets etc., then the developer, original publisher, or whoever the current rights owner is, won't see a single cent of your purchase. To them, it's really no different from a pirated copy. ( And for what it's worth, a quick internet download is also better for the environment, compared to ordering the game by mail, from who knows where. ) Games were created to be played and enjoyed by people, and if the current owners are making zero efforts to make these games available to the public, then it's perfectly fair to acquire them through other, less official means. There's always the option to buy a legal license later on, if they ever make the game available again.

That's why I pirate games, for the environment.

Oh my, the holier than thou attitude of some people. I have a news flash for you, buying second hand games is also a grey area. That's why GOG can't just sell Command and Conquer, and then send the money into the void to EA, hoping to not get sued.

If we are to get pedantic about it, the only legal transaction is you paying money to the rights holder, or to entities approved by the rights holder. From a law point of view everything else is illegal. Grey area, in this case, is just an invention to cover things that are not technically hurting rights holders.
